Synopsis

Since 1979, there has been a number of important judgments by the courts on arbitration law. There has been increased interest in the use of arbitration as a means of settling disputes. Internationally, there has been an upsurge of interest in arbitration law and practice. This development has been characterized by the publication of several books and articles and papers which explain and critically assess current arbitration law and practice. This book discusses principles of current South African arbitration law and practice in the light of recent trends in other countries, particularly England. The process of arbitration is systematically explained, from the conclusion of the arbitration agreement to the delivery and enforcement of the arbitrator's award, with practical advice to the arbitrator on dealing with problems which are likely to arise in the course of the proceedings. The book is intended particularly for arbitrators, lawyers and other professional advisers to parties in arbitration proceedings as well as students in the field. For the benefit of those without a formal legal background, the basic principles of the law of evidence in the context of arbitration proceedings and their practical applicaiton are briefly explained. Although the book mainly refers to arbitration in the construction industry, the principles of arbitration law and practice apply to all forms of arbitration. The book should be of interest to those involved other areas of arbitration as well.
